Venezuelan TPS May Return on November 6: What Venezuelan Applicants Should Know
A federal appeals court has opened the door for Venezuelan TPS protections to come back, but the story is not finished. On Friday, October 30, 2026, a three-judge panel of the Ninth Circuit Court of Appeals denied the government's request for a stay in the National TPS Alliance case. To understand why this matters, it helps to know what came before. In 2025, the Supreme Court paused a lower court order that had protected Venezuelans, and that pause let the government's termination take effect. On October 5, 2026, the Supreme Court vacated an earlier Ninth Circuit judgment and returned the case for reconsideration in light of its June decision in Mullin v. Doe. The key date now is November 6. That stay is set to expire next Friday, November 6. If nothing else happens, hundreds of thousands of Venezuelans who were stripped of TPS would see their status reinstated on November 6 while litigation challenging the vacatur and termination continues. The ruling is not the final word. Friday's decision did not resolve the underlying legal challenge. The government can still ask the Supreme Court to step in before November 6, and the Supreme Court has done so before in this case. Legal experts expect the fight to continue. The Venezuela TPS dates have also been confusing for many families. Earlier DHS notices had extended Venezuela's designation through October 2, 2026, and the extension allowed approximately 607,000 current beneficiaries to retain TPS through Oct. 2, 2026, if they still met the eligibility rules. That October 2 date has now passed, and not everyone agrees on what it means for work permits. Some legal commentators say the cards marked with that date are no longer valid for most holders. Others point to earlier USCIS guidance that Venezuelan TPS holders who received TPS-related documents on or before February 5, 2025, with an expiration date of October 2, 2026, will maintain work authorization through that date. Because these views differ, do not rely on any single summary. What this means for you: If you are a Venezuelan TPS holder, or you are helping a family member who is, watch for official updates from USCIS and the court around November 6. A news report alone does not change your status. Check the expiration date on your work permit and any USCIS notices you received, and keep copies of every document. Be careful about starting a new job or changing your paperwork based only on rumors. Employers may also have questions about Form I-9, so it can help to bring your official documents to any work verification. If your case is pending, or if you have a Form I-821 or Form I-765 in process, check the official TPS Venezuela page on uscis.gov for the latest instructions. If you have been detained, received a removal notice, or are unsure how a court decision affects you, talk to an immigration attorney as soon as possible. Free or low-cost legal help may also be available through local nonprofit organizations. This article is general information, not legal advice.
